Boom Share, a trade name of Albert D Matalon, LLC, a company registered in California, United States, (Boom) provides a personalized subscription service that allows users to access our Application (as defined below) via the internet. These terms of use (Terms) govern your use of our Application and any agreement concluded in respect thereof and also apply in case you use our Application without an Account (as defined below). If you have any questions or complaints in relation to these Terms, our application (website) and services or any agreement concluded with us or if you would like to receive more information, please contact us via support@boomapp.com.
1. Definitions and Applicability
In these terms:
- Account means a registered profile of a User on the Application;
- Application means the Boom App mobile application and related services;
- User means any person who accesses or uses the Application.
2. Accounts and Eligibility
Eligibility
- Must be at least 13 years old
- Users between 13-18 require parental consent
- Not intended for children under 13
Account Registration
- Provide accurate, current information
- Maintain account credential confidentiality
- Responsible for all account activities
Account Security
- Notify support@boomapp.com of unauthorized access
- Company not liable for security breaches
3. Acceptable Use
Users agree NOT to:
- Use the App for unlawful purposes
- Post offensive or infringing content
- Harass or threaten users
- Impersonate others
- Introduce malware
- Attempt unauthorized system access
- Reverse engineer the App
- Violate intellectual property rights
4. User Content and Ownership
- Users retain rights to their content
- Boom App receives a non-exclusive license to use content for service operations
- Users responsible for content legality
- Company reserves right to remove content
5. Intellectual Property
- Boom App owns all App content except user-generated content
- Limited personal, non-transferable license granted to users
- Feedback can be used without compensation
6. Payments and Subscriptions
- Fees are non-refundable
- Automatic renewal unless canceled
- Pricing subject to change
- Free trials available with limitations
7. Privacy and Data Protection
- Governed by separate Privacy Policy
- Complies with GDPR and CCPA
8. Termination of Use
- Users can delete account anytime
- Company can terminate for policy violations
- Some provisions survive account termination
9. Warranties and Liability Disclaimers
- App provided "AS IS"
- No guarantees of uninterrupted service
- Liability limited by law
10. Dispute Resolution
- Governed by California law
- Preference for informal resolution
